Terms of Service

1. Acceptance of Terms

By accessing or using StoryMaker.Space ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. You represent that you are not located in a country subject to U.S. government embargo or designated as supporting terrorism, and that you will not use the Service in violation of applicable export or sanctions laws.

2. Changes to the Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. For material changes, we will notify you by email or a prominent notice in the Service. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service.

3. Description of Service

StoryMaker.Space is an AI-powered storytelling platform that allows users to create, narrate, illustrate, and share original stories. The Service includes story generation, audio narration, image generation, community sharing, and integration with third-party devices such as Yoto players.

The Service may integrate with or link to third-party services (e.g., payment processors, devices). Your use of those services is subject to their terms and policies. We are not responsible for third-party services.

4. User Accounts & Registration

To access certain features, you must create an account. You agree to provide accurate, complete information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

Accounts may be created by individuals 13 years of age or older. Users under 18 should have parental permission. We do not knowingly collect personal information from children under 13 without parental consent (see our Privacy Policy).

5. Content Ownership & License

You retain ownership of the content you submit to the Service, including story prompts, edits, and uploaded materials ("Your Content"). By submitting content, you grant StoryMaker.Space a non-exclusive, worldwide, royalty-free license to store, display, and distribute Your Content solely to provide the Service.

The Service, including its design, features, code, trademarks, and logos, is owned by StoryMaker.Space or its licensors. You may not copy, modify, distribute, or create derivative works from our service or brand except as necessary to use the Service in accordance with these Terms.

You may delete your content at any time. Upon deletion, we will remove it from active storage within a reasonable period, subject to backup and legal retention requirements.

6. AI-Generated Content Policy

Stories, narrations, and images generated through the Service using your prompts are considered Your Content. StoryMaker.Space does not claim ownership over AI-generated outputs produced from your inputs. You are responsible for ensuring your use of generated content complies with applicable laws.

7. Acceptable Use Policy

StoryMaker.Space is a family-friendly platform. You agree not to use the Service to create, submit, or share content that is:

• Sexually explicit, pornographic, or adult in nature
• Gratuitously violent, gory, or disturbing
• Hateful, discriminatory, or targeted harassment
• Illegal or promoting illegal activities
• Spam, phishing, or designed to deceive
• In violation of third-party intellectual property rights

We reserve the right to remove content and suspend accounts that violate these policies.

8. Payment Terms & Subscriptions

Certain features require a paid subscription. Subscriptions are billed monthly or annually as selected and automatically renew at the end of each period unless you cancel before the renewal date. All payments are processed securely through our payment processor. By subscribing, you authorize us to charge your payment method on a recurring basis. We will charge the then-current price unless we have notified you of a price change in advance (e.g., by email or in-app notice); continued use after the change constitutes acceptance.

You are responsible for keeping your payment method current. If a payment fails, we may retry and/or suspend access until the payment is updated.

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period; no pro-rated refunds are provided except where required by law.

9. Privacy & Data

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimers & Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate or appropriate for all purposes.

To the maximum extent permitted by law, StoryMaker.Space's liability for any claim arising from these Terms or use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless StoryMaker.Space and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) Your Content, (c) your violation of these Terms, or (d) your violation of any third-party rights or applicable law.

12. Termination

We may suspend or terminate your account at any time for violations of these Terms. You may terminate your account by contacting us. Upon termination, your right to use the Service ceases immediately.

After termination, we may retain your data as described in our Privacy Policy (e.g., backups, legal obligations). You may request account and data deletion per the Privacy Policy.

Provisions that by their nature should survive (including ownership, license grants, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution) survive termination.

13. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. The Service is operated by a company registered and operating in New Jersey. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state and federal courts located in New Jersey.

14. General

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect.

These Terms, together with the Privacy Policy and any other policies we reference, constitute the entire agreement between you and StoryMaker.Space regarding the Service and supersede any prior agreements.

15. Copyright and DMCA

We respect intellectual property rights. If you believe content on the Service infringes your copyright, please send a DMCA notice to our designated agent at hello@storymaker.space. Your notice must include the elements required by 17 U.S.C. § 512(c)(3). We may terminate accounts of repeat infringers in appropriate circumstances.
